The vice mayor of EB Magalona, Negros Occidental , yesterday announced that he has filed complaints against the town's mayor and six councilors before the Ombudsman for violation of the Anti-Graft and Corrupt Practices Act and for Grave Misconduct.
At a press conference in Bacolod City, Vice Mayor Robert Acalingsaid he filedthe complaints against EBMagalona Mayor Marvin Malacon and councilors Joey Pugales, ReylanGamboa Sr., Isidro Gomed Jr., Eric Matulac, GelitaParcon and JovieMadayag.
Malacon, when reached by the DAILY STAR yesterday, said “For the time being, we reserve our comment or reaction, as we have not received any official document. Rest assured we will give our side as soon as we have it”.
Acalingsaid it was his call of duty and conscience as a public servant that compelled him to file the complaints.
These charges were filed because of the unscrupulous use of public funds and abuse of authority committed by Malacon in collaboration with some members of the Sangguniang Bayan who illegally used and malversed public funds, he claimed.
“Mayor Malcon whimsically and capriciously utilized funds of the municipality even without authority from the Office of the Sangguniang Bayan and oftentimes would initiate special sessions in collaboration with some members of the local legislative body without informing me as vice mayor and presiding officer,” he said.
“It is high time that such illegal acts considered prejudicial to the interest of the people of EB Magalonabe put to a stop,” Acaling said.
The charges he filed against Malaconare presently under preliminary and administrative investigation by the Ombudsman, he said.
Acaling also questioned Malacon's recently entering into a loan contract with the Land Bank of the Philippines for P200 million for the renovation of the town's public market, purchase of heavy equipment, and computerization.
This is beyond the capacity of the municipality to pay and would consequently result in the deprivation of basic services due the people of EB Magalona, the vice mayor said.
Acaling said he also filed charges of usurpation of authority and misconduct against the six councilors for holding sessions without his consent.
He is also prepared to file charges against department heads and some barangay captains working in connivance with the mayor in the questionable use of public funds, Acaling added.
Acaling said his actions were not politically motivated and were intended to protect the interest of the people of EB Magalona.
Asked if he would run for mayor against Malacon in 2019, Acaling said he has several options – he could run for mayor, vice mayor or just work on developing his family's land in EB Magalona, that will benefit the people.*CPG
