The Bacolod City Sangguniang Panlungsod unanimously approved on second reading a proposed ordinance regulating the drinking and bringing of alcoholic beverages in public and private cemeteries in Bacolod City, Wednesday.
The proposed ordinance also includes the imposition of a special “Tigkalalag/Undas/Piyesta Minatay” liquor ban to promote public safety, order, and respect for the dead during the annual commemoration period.
Authored by Councilor Caesar Distrito, the measure establishes clear rules for cemetery conduct, public information protocols, enforcement guidelines, and penalties for violations. It also provides limited exemptions for bona fide religious rites and regulated establishments operating inside memorial parks.
“This is a public safety and public order measure, especially during the Undas season when large crowds gather in cemeteries. We want families to commemorate their loved ones in a peaceful environment, safe, orderly, and respectful. This ordinance sets clear rules so that everyone knows what is allowed and what is prohibited.” Distrito said.
Under the proposed ordinance, the City will implement year-round prohibitions that make it unlawful to: consume alcoholic beverages in any public place within a cemetery; or possess an open container of alcoholic beverage in any public place within a cemetery.
The ordinance further strengthens enforcement during the annual Tigkalalag/Undas/Piyesta Minatay period, defined as covering October 31 to November 3, when crowd levels are highest and safety risks increase.
“The Undas season is a time of remembrance, but it is also a period when accidents, disturbances, and safety incidents can happen if drinking is unchecked. Our goal is prevention, protecting the public, and ensuring decency in places meant for prayer and remembrance.” Distrito further explained.
It also authorizes the City to establish checkpoints at cemetery entry points for limited purposes, including inspecting bags and parcels for alcoholic beverages, documenting prohibited items, and supporting crowd and traffic management.
To ensure the public is well-informed, the ordinance requires the Public Information Office to conduct a citywide information campaign at least two weeks before the Tigkalalag/Undas/Piyesta Minatay period each year through broadcast, online platforms, and postings at cemetery entrances and barangay halls.
Violators may face penalties including fines and community service for initial offenses, with higher fines and possible imprisonment for repeated violations, while administrative sanctions will also be imposed on licensed establishments inside memorial parks found tolerating violations, ranging from written warnings to suspension or revocation of permits.
The ordinance, which was approved unanimously on second reading Wednesday, is expected to be approved on third and final reading during the next session. Once approved, it will take effect 15 days after publication in a newspaper of general circulation in the City of Bacolod.*
