The driver of the cargo truck that figured in an accident that claimed the lives of two persons in Brgy. Caduh-an, Cadiz City, Negros Occidental Friday, was released from police custody after the lapse of the 18-hour reglementary period of detention, police chief Lt. Col. Robert Mansueto said yesterday.

The two victims were identified by the Cadiz police as John Eurich Depasupil, 28, a teacher assigned at the Vicente Patricio Memorial Elementary School in Brgy. Magsaysay, Cadiz City, and John Paul Ladrillo, 30, a nurse assigned at the Cadiz District Hospital.

The Mitsubishi cargo truck driven by Mario Bendevel ran over Depasupil and Ladrillo on Friday in Barangay Caduha-an, Cadiz City, the police said.

Despite being released from police custody, Mansueto said they will file charges against Bendevel today, if the families of the victims will not agree to a settlement.

Initial police investigations showed that Ladrillo, who was driving a Yamaha Mio motorcycle, with Depasupil as back-rider, tried to overtake the cargo hauler truck, while both vehicles were running from south to north direction.

Both victims were ran over by the cargo truck after the motorcycle fell on the road, investigations of the Cadiz police showed.

Ladrillo died on the spot while Depasupil was declared dead on arrival at the Cadiz District Hospital, where he was brought by an ambulance of Toboso town.*GPB
