The evidence against a terminated Negros Occidental provincial government lawyer was not fabricated, Provincial Administrator Rayfrando Diaz said yesterday.

Diaz was reacting to the statement of lawyer Roxenne Sumanting, a recently terminated Negros Occidental Provincial Legal Office employee, that the decision against her was based on fabricated evidence and in retaliation to cases she filed against provincial government officials before the Office of the Ombudsman.

The recommendation of the legal officer to Gov. Eugenio Jose Lacson for the dismissal of Sumanting was based on actual evidence, Diaz said, citing the “falsification of daily time records”.

“We have to follow the law, no one is above the law,” he said.

“We have to respect the disciplining authority…if Sumanting does not agree with the decision, she has the right to file an appeal,” Diaz added.

Diaz said he has nothing personal against Sumanting, he does not even know her.

It is just not right for the provincial government to pay an employee who does not have actual output more than P70,000 a month, he added.*
